Relevant Legal Bases

Below you will find an overview of the legal bases of the GDPR on the basis of which we process personal data. Please note that, in addition to the provisions of the GDPR, national data protection requirements may apply in your or our country of residence or domicile. Should more specific legal bases be relevant in individual cases, we will inform you of these in the privacy policy.

  • Consent (Art. 6(1) sentence 1 lit. a) GDPR) – The data subject has given consent to the processing of personal data concerning them for one specific purpose or several specific purposes.
  • Performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR) – Processing is necessary for the performance of a contract to which the data subject is a party, or for the implementation of pre-contractual measures carried out at the request of the data subject.
  • Legal obligation (Art. 6(1) sentence 1 lit. c) GDPR) – Processing is necessary for compliance with a legal obligation to which the controller is subject.
  • Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR) – Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data.

In addition to the data protection provisions of the General Data Protection Regulation, national data protection regulations apply in Germany. These include in particular the Act on Protection against the Misuse of Personal Data in Data Processing (Federal Data Protection Act – BDSG). The BDSG contains, in particular, special provisions on the right of access, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes and transmission, as well as automated decision-making in individual cases, including profiling. Furthermore, it regulates data processing for the purposes of the employment relationship (§ 26 BDSG), in particular with regard to the establishment, performance or termination of employment relationships as well as the consent of employees. In addition, state data protection laws of the individual federal states may apply.

Security Measures

We take appropriate technical and organizational measures in accordance with the legal requirements, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing, as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, in order to ensure a level of protection appropriate to the risk. The measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as the access, input, transfer, securing of availability and separation of the data relating to them. Furthermore, we have established procedures that ensure the exercise of data subjects’ rights, the erasure of data and responses to threats to the data. In addition, we already take the protection of personal data into account in the development and selection of hardware, software and procedures in accordance with the principle of data protection by design and by default.

Transmission of Personal Data

In the course of our processing of personal data, the data may be transmitted to other bodies, companies, legally independent organizational units or persons, or disclosed to them. The recipients of this data may include, for example, service providers commissioned with IT tasks or providers of services and content that are integrated into a website. In such cases, we observe the legal requirements and in particular conclude corresponding contracts or agreements that serve to protect your data with the recipients of your data.

Data Processing in Third Countries

If we process data in a third country (i.e., outside the European Union (EU) or the European Economic Area (EEA)), or if the processing takes place in the context of using third-party services or the disclosure or transfer of data to other persons, bodies or companies, this only occurs in accordance with the legal requirements.

Subject to express consent or transfer required by contract or law, we process or have the data processed only in third countries with a recognized level of data protection, on the basis of a contractual obligation through so-called standard contractual clauses of the EU Commission, where certifications exist, or where binding internal data protection rules exist (Art. 44 to 49 GDPR, information page of the EU Commission: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection_en).

Erasure of Data

The data processed by us will be erased in accordance with the legal requirements as soon as the consents permitted for processing are revoked or other permissions cease to apply (e.g. if the purpose of processing this data no longer applies or it is not required for the purpose). If the data is not erased because it is required for other and legally permissible purposes, its processing is restricted to these purposes. This means the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons, or whose storage is necessary for the assertion, exercise or defense of legal claims, or for the protection of the rights of another natural or legal person. Our privacy notices may also contain further information on the retention and erasure of data that takes precedence for the respective processing operations.

Business Services

We process data of our contractual and business partners, e.g. customers and interested parties (collectively referred to as “contractual partners”), within the framework of contractual and comparable legal relationships as well as associated measures, and in the context of communication with the contractual partners (or pre-contractually), e.g. to answer inquiries.

We process this data in order to fulfill our contractual obligations. These include, in particular, the obligations to provide the agreed services, any update obligations, and remedies in the event of warranty issues and other service disruptions. In addition, we process the data to safeguard our rights and for the purpose of the administrative tasks associated with these obligations as well as company organization. Furthermore, we process the data on the basis of our legitimate interests in proper and economically efficient business management, as well as in security measures to protect our contractual partners and our business operations from misuse and from endangerment of their data, secrets, information and rights (e.g. for the involvement of telecommunications, transport and other auxiliary services as well as subcontractors, banks, tax and legal advisors, payment service providers or tax authorities). Within the framework of applicable law, we only pass on the data of contractual partners to third parties insofar as this is necessary for the aforementioned purposes or to fulfill legal obligations. Contractual partners will be informed about further forms of processing, e.g. for marketing purposes, in the context of this privacy policy.

We inform the contractual partners which data is required for the aforementioned purposes before or in the course of data collection, e.g. in online forms, by means of special markings (e.g. colors) or symbols (e.g. asterisks or similar), or personally.

We erase the data after expiry of statutory warranty and comparable obligations, i.e. generally after 4 years, unless the data is stored in a customer account, e.g. as long as it must be retained for legal archiving reasons. The statutory retention period is ten years for documents relevant under tax law as well as for trading books, inventories, opening balance sheets, annual financial statements, the work instructions and other organizational documents necessary to understand these documents, and accounting records; and six years for received commercial and business letters and reproductions of dispatched commercial and business letters. The period begins at the end of the calendar year in which the last entry was made in the book, the inventory, opening balance sheet, annual financial statement or management report was drawn up, the commercial or business letter was received or dispatched, or the accounting record was created, the record was made, or the other documents arose.

Insofar as we use third-party providers or platforms to provide our services, the terms and conditions and privacy notices of the respective third-party providers or platforms apply in the relationship between the users and the providers.

  • Shop and e-commerce: We process the data of our customers in order to enable them to select, purchase or order the chosen products, goods and associated services, as well as their payment and delivery or execution. Insofar as necessary for the execution of an order, we use service providers, in particular postal, freight and shipping companies, to carry out the delivery or execution to our customers. For the handling of payment transactions, we use the services of banks and payment service providers. Registration, Login and User Account

Users can create a user account. During registration, users are informed of the required mandatory information, which is processed for the purposes of providing the user account on the basis of contractual performance. The data processed includes, in particular, login information (username, password and an e-mail address). In the context of using our registration and login functions as well as the use of the user account, we store the IP address and the time of the respective user action. This storage takes place on the basis of our legitimate interests as well as those of the users in protection against misuse and other unauthorized use. As a rule, this data is not passed on to third parties, unless it is necessary to pursue our claims or there is a legal obligation to do so. Users may be informed by e-mail of matters relevant to their user account, such as technical changes.

Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. e-mail, telephone numbers); content data (e.g. entries in online forms); meta/communication data (e.g. device information, IP addresses).
Data subjects: Users (e.g. website visitors, users of online services).
Purposes of processing: Provision of contractual services and customer service; security measures; administration and response to inquiries; provision of our online offering and user-friendliness.
Legal bases: Performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR); legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR).

Further notes on processing operations, procedures and services:

  • Registration with real names: Due to the nature of our community, we ask users to use our offering only under their real names. This means the use of pseudonyms is not permitted; legal bases: Performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR).
  • User profiles are public: The profiles of the users are publicly visible and accessible; legal bases: Performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR).
  • Erasure of data after cancellation: If users have cancelled their user account, their data relating to the user account will be erased, subject to a legal permission, obligation or consent of the users; legal bases: Performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR).
  • No obligation to retain data: It is the responsibility of the users to back up their data before the end of the contract upon cancellation. We are entitled to irretrievably erase all data of the user stored during the term of the contract; legal bases: Performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR).

Blogs and Publication Media

We use blogs or comparable means of online communication and publication (hereinafter “publication medium”). The data of readers is processed for the purposes of the publication medium only insofar as it is necessary for its presentation and the communication between authors and readers, or for reasons of security. For the rest, we refer to the information on the processing of visitors to our publication medium within the framework of these privacy notices.

Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. e-mail, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta/communication data (e.g. device information, IP addresses).
Data subjects: Users (e.g. website visitors, users of online services).
Purposes of processing: Provision of contractual services and customer service; feedback (e.g. collecting feedback via online form); provision of our online offering and user-friendliness; security measures; administration and response to inquiries.
Legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR).

Further notes on processing operations, procedures and services:

  • Comments and contributions: When users leave comments or other contributions, their IP addresses may be stored on the basis of our legitimate interests. This is done for our security, in case someone leaves unlawful content in comments and contributions (insults, prohibited political propaganda, etc.). In this case, we ourselves may be held liable for the comment or contribution and are therefore interested in the identity of the author. Furthermore, we reserve the right to process the users’ information for the purpose of spam detection on the basis of our legitimate interests. On the same legal basis, we reserve the right, in the case of surveys, to store the IP addresses of users for the duration of the survey and to use cookies to avoid multiple votes. The personal information communicated in the context of comments and contributions, any contact and website information, as well as the content information, are stored by us permanently until the users object; legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR).
  • Akismet anti-spam check: We use the service “Akismet” on the basis of our legitimate interests. With the help of Akismet, comments from real people are distinguished from spam comments. For this purpose, all comment information is sent to a server in the USA, where it is analyzed and stored for comparison purposes for four days. If a comment has been classified as spam, the data is stored beyond this time. This information includes the entered name, the e-mail address, the IP address, the comment content, the referrer, information about the browser used and the computer system, and the time of the entry. Users are welcome to use pseudonyms or to refrain from entering the name or e-mail address. You can completely prevent the transfer of data by not using our comment system. That would be a pity, but unfortunately we see no alternatives that work just as effectively; service provider: Aut O’Mattic A8C Ireland Ltd., Grand Canal Dock, 25 Herbert Pl, Dublin, D02 AY86, Ireland; legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR); website: https://automattic.com; privacy policy: https://automattic.com/privacy.

Contact and Inquiry Management

When contacting us (e.g. via contact form, e-mail, telephone or via social media), as well as within the framework of existing user and business relationships, the information of the inquiring persons is processed insofar as this is necessary to answer the contact inquiries and any requested measures.

Types of data processed: Contact data (e.g. e-mail, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta/communication data (e.g. device information, IP addresses).
Data subjects: Communication partners.
Purposes of processing: Contact inquiries and communication; administration and response to inquiries; feedback (e.g. collecting feedback via online form); provision of our online offering and user-friendliness.
Legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR); performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR).

Further notes: Contact form – When users contact us via our contact form, e-mail or other communication channels, we process the data communicated to us in this context to process the matter raised; legal bases: Performance of a contract and pre-contractual inquiries (Art. 6(1) sentence 1 lit. b) GDPR), legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR).

Newsletter and Electronic Notifications

We send newsletters, e-mails and other electronic notifications (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. Insofar as the contents of the newsletter are specifically described during registration, they are decisive for the consent of the users. Otherwise, our newsletters contain information about our services and us. To subscribe to our newsletters, it is generally sufficient to provide your e-mail address. However, we may ask you to provide a name for the purpose of personal address in the newsletter, or other information, insofar as this is necessary for the purposes of the newsletter.

Double opt-in procedure: Subscription to our newsletter generally takes place in a so-called double opt-in procedure. This means that, after registering, you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no one can register with someone else’s e-mail address. Subscriptions to the newsletter are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes the storage of the registration and confirmation time as well as the IP address. Likewise, changes to your data stored with the dispatch service provider are logged.

Erasure and restriction of processing: We may store the unsubscribed e-mail addresses for up to three years on the basis of our legitimate interests before erasing them, in order to be able to prove a previously given consent. The processing of this data is restricted to the purpose of a possible defense against claims. An individual request for erasure is possible at any time, provided that the former existence of a consent is confirmed at the same time. In the case of obligations to permanently observe objections, we reserve the right to store the e-mail address solely for this purpose in a blocklist.

The logging of the registration procedure takes place on the basis of our legitimate interests for the purpose of proving its proper conduct. Insofar as we commission a service provider with the dispatch of e-mails, this takes place on the basis of our legitimate interests in an efficient and secure dispatch system.

Contents: Information about us, our services, promotions and offers.
Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. e-mail, telephone numbers); meta/communication data (e.g. device information, IP addresses); usage data (e.g. websites visited, interest in content, access times).
Data subjects: Communication partners; users (e.g. website visitors, users of online services).
Purposes of processing: Direct marketing (e.g. by e-mail or post); provision of contractual services and customer service.
Legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR).
Opt-out: You can cancel the receipt of our newsletter at any time, i.e. revoke your consent or object to further receipt. You will find a link to cancel the newsletter either at the end of each newsletter, or you can otherwise use one of the contact options listed above, preferably e-mail, for this purpose.

Promotional Communication via E-mail, Post, Fax or Telephone

We process personal data for the purposes of promotional communication, which may take place via various channels, such as e-mail, telephone, post or fax, in accordance with the legal requirements. The recipients have the right to revoke consent given at any time or to object to promotional communication at any time. After revocation or objection, we store the data necessary to prove the previous authorization for contact or dispatch for up to three years after the end of the year of the revocation or objection, on the basis of our legitimate interests. The processing of this data is restricted to the purpose of a possible defense against claims. On the basis of the legitimate interest in permanently observing the revocation or objection of users, we also store the data necessary to avoid renewed contact (e.g., depending on the communication channel, the e-mail address, telephone number, name).

Types of data processed: Inventory data (e.g. names, addresses); contact data (e.g. e-mail, telephone numbers).
Data subjects: Communication partners.
Purposes of processing: Direct marketing (e.g. by e-mail or post).
Legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR).

Web Analysis, Monitoring and Optimization

Web analysis (also referred to as “reach measurement”) serves to evaluate the visitor flows of our online offering and may include behavior, interests or demographic information about visitors, such as age or gender, as pseudonymous values. With the help of reach analysis, we can, for example, recognize at what time our online offering or its functions or content are most frequently used, or invite reuse. We can likewise understand which areas require optimization. In addition to web analysis, we may also use testing procedures, e.g. to test and optimize different versions of our online offering or its components.

Unless otherwise stated below, profiles, i.e. data summarized for a usage process, may be created for these purposes, and information may be stored in a browser or in an end device and read out from it. The information collected includes, in particular, websites visited and elements used there, as well as technical information such as the browser used, the computer system used, and information on usage times. Insofar as users have consented to the collection of their location data, location data may also be processed. The IP addresses of users are also stored. However, we use an IP masking procedure (i.e. pseudonymization by shortening the IP address) to protect users. As a rule, no clear data of users (such as e-mail addresses or names) is stored in the context of web analysis, A/B testing and optimization, but rather pseudonyms. This means that we, as well as the providers of the software used, do not know the actual identity of the users, but only the information stored in their profiles for the purposes of the respective procedures.

Types of data processed: Usage data (e.g. websites visited, interest in content, access times); meta/communication data (e.g. device information, IP addresses).
Data subjects: Users (e.g. website visitors, users of online services).
Purposes of processing: Reach measurement (e.g. access statistics, recognition of returning visitors); profiles with user-related information (creation of user profiles); tracking (e.g. interest/behavior-related profiling, use of cookies); provision of our online offering and user-friendliness.
Security measures: IP masking (pseudonymization of the IP address).
Legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR).

Further notes on processing operations, procedures and services:

  • Google Optimize: Use of Google Analytics data for the purpose of improving areas of our online offering and better aligning our marketing measures with the potential interests of users; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://optimize.google.com; privacy policy: https://policies.google.com/privacy; data processing agreement: https://business.safety.google/adsprocessorterms; standard contractual clauses (ensuring the level of data protection when processing in third countries): https://business.safety.google/adsprocessorterms; further information: https://privacy.google.com/businesses/adsservices.
  • Google Analytics: Web analysis, reach measurement and measurement of user flows; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://marketingplatform.google.com/intl/de/about/analytics/; privacy policy: https://policies.google.com/privacy; data processing agreement: https://business.safety.google/adsprocessorterms; standard contractual clauses: https://business.safety.google/adsprocessorterms; opt-out: opt-out plugin: https://tools.google.com/dlpage/gaoptout?hl=de, settings for the display of advertisements: https://adssettings.google.com/authenticated; further information: https://privacy.google.com/businesses/adsservices.
  • Google Analytics 4: We use Google Analytics to carry out a user analysis on the basis of a pseudonymous user identification number. This identification number does not contain any unique data, such as names or e-mail addresses. It serves to assign analysis information to an end device in order to recognize which content the users have accessed within one or several usage processes, which search terms they have used, accessed again, or interacted with our online offering. The time and duration of use are also stored, as well as the sources of the users that refer to our online offering, and technical aspects of their end devices and browsers. In doing so, pseudonymous profiles of users are created with information from the use of various devices, whereby cookies may be used. In Analytics, data on geographic location is provided at a higher level by capturing the following metadata via IP lookup: “city” (and the derived latitude and longitude of the city), “continent”, “country”, “region”, “subcontinent” (and the ID-based equivalents). To ensure the protection of user data in the EU, Google receives and processes all user data via domains and servers within the EU. The IP address of users is not logged and is shortened by the last two digits by default. The shortening of the IP address takes place on EU servers for EU users. In addition, all sensitive data collected from users in the EU is deleted before being captured via EU domains and servers; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://marketingplatform.google.com/intl/de/about/analytics/; privacy policy: https://policies.google.com/privacy; data processing agreement: https://business.safety.google/adsprocessorterms/; standard contractual clauses: https://business.safety.google/adsprocessorterms; opt-out: opt-out plugin: https://tools.google.com/dlpage/gaoptout?hl=de, settings for the display of advertisements: https://adssettings.google.com/authenticated; further information: https://privacy.google.com/businesses/adsservices.
  • Google Tag Manager: Google Tag Manager is a solution with which we can manage so-called website tags via an interface and thus integrate other services into our online offering (see further information in this privacy policy). With the Tag Manager itself (which implements the tags), no profiles of users are created and no cookies are stored. Google only learns the IP address of the user, which is necessary to run the Google Tag Manager; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://marketingplatform.google.com; privacy policy: https://policies.google.com/privacy; data processing agreement: https://business.safety.google/adsprocessorterms; standard contractual clauses: https://business.safety.google/adsprocessorterms; further information: https://privacy.google.com/businesses/adsservices.

Online Marketing

We process personal data for the purposes of online marketing, which may include, in particular, the marketing of advertising space or the display of advertising and other content (collectively referred to as “content”) based on the potential interests of users, as well as the measurement of its effectiveness. For these purposes, so-called user profiles are created and stored in a file (so-called “cookie”), or similar procedures are used by means of which the information about the user relevant for the display of the aforementioned content is stored. This information may include, for example, content viewed, websites visited, online networks used, but also communication partners and technical information, such as the browser used, the computer system used, as well as information on usage times and functions used. Insofar as users have consented to the collection of their location data, this may also be processed.

The IP addresses of users are also stored. However, we use available IP masking procedures (i.e. pseudonymization by shortening the IP address) to protect users. As a rule, no clear data of users (such as e-mail addresses or names) is stored in the context of the online marketing procedure, but rather pseudonyms. This means that we, as well as the providers of the online marketing procedures, do not know the actual identity of the users, but only the information stored in their profiles. The information in the profiles is generally stored in cookies or by means of similar procedures. These cookies can later generally also be read out on other websites that use the same online marketing procedure, and analyzed for the purposes of displaying content, as well as supplemented with further data and stored on the server of the online marketing procedure provider.

In exceptional cases, clear data can be assigned to the profiles. This is the case, for example, if the users are members of a social network whose online marketing procedure we use, and the network links the users’ profiles with the aforementioned information. Please note that users may make additional agreements with the providers, e.g. by giving consent during registration. As a rule, we only receive access to summarized information about the success of our advertisements. However, in the context of so-called conversion measurements, we can check which of our online marketing procedures have led to a so-called conversion, i.e., for example, to a conclusion of contract with us. The conversion measurement is used solely to analyze the success of our marketing measures. Unless otherwise stated, please assume that the cookies used are stored for a period of two years.

Types of data processed: Usage data (e.g. websites visited, interest in content, access times); meta/communication data (e.g. device information, IP addresses).
Data subjects: Users (e.g. website visitors, users of online services).
Purposes of processing: Reach measurement (e.g. access statistics, recognition of returning visitors); tracking (e.g. interest/behavior-related profiling, use of cookies); marketing; profiles with user-related information (creation of user profiles); conversion measurement (measurement of the effectiveness of marketing measures).
Security measures: IP masking (pseudonymization of the IP address).
Legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR).
Opt-out: We refer to the privacy notices of the respective providers and the opt-out options stated for the providers. Where no explicit opt-out option has been stated, you can disable cookies in your browser settings, although this may restrict functions of our online offering. We therefore additionally recommend the following opt-out options, offered collectively for the respective regions: a) Europe: https://www.youronlinechoices.eu. b) Canada: https://www.youradchoices.ca/choices. c) USA: https://www.aboutads.info/choices. d) Cross-regional: https://optout.aboutads.info.

Further notes on processing operations, procedures and services:

  • Google Ads and conversion measurement: We use the online marketing procedure “Google Ads” to place advertisements in the Google advertising network (e.g. in search results, in videos, on websites, etc.) so that they are displayed to users who have a presumed interest in the advertisements. Furthermore, we measure the conversion of the advertisements. However, we only learn the anonymous total number of users who clicked on our advertisement and were redirected to a page provided with a so-called “conversion tracking tag”. We ourselves, however, do not receive any information by which users can be identified; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://marketingplatform.google.com; privacy policy: https://policies.google.com/privacy; further information: https://privacy.google.com/businesses/adsservices; controller-controller data processing terms and standard contractual clauses for third-country transfers: https://business.safety.google/adscontrollerterms.
  • Google AdSense with personalized advertisements: We use the Google AdSense service with personalized advertisements, with the help of which advertisements are displayed within our online offering and we receive remuneration for their display or other use; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://marketingplatform.google.com; privacy policy: https://policies.google.com/privacy; further information: https://privacy.google.com/businesses/adsservices; controller-controller data processing terms and standard contractual clauses for third-country transfers: https://business.safety.google/adscontrollerterms.
  • Google AdSense with non-personalized advertisements: We use the Google AdSense service with non-personalized advertisements, with the help of which advertisements are displayed within our online offering and we receive remuneration for their display or other use; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://marketingplatform.google.com; privacy policy: https://policies.google.com/privacy; further information: https://privacy.google.com/businesses/adsservices; controller-controller data protection terms and standard contractual clauses for third-country transfers: https://business.safety.google/adscontrollerterms.

Presences in Social Networks (Social Media)

We maintain online presences within social networks and, in this context, process data of users in order to communicate with the users active there, or to offer information about us. We point out that data of users may be processed outside the territory of the European Union. This may result in risks for the users because, for example, it could make it more difficult to enforce the rights of the users. Furthermore, the data of users within social networks is generally processed for market research and advertising purposes. For example, usage profiles can be created on the basis of the usage behavior and the resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside the networks that presumably correspond to the interests of the users. For these purposes, cookies are generally stored on the users’ computers, in which the usage behavior and the interests of the users are stored. Furthermore, data may also be stored in the usage profiles independently of the devices used by the users (in particular, if the users are members of the respective platforms and are logged in to them).

For a detailed presentation of the respective forms of processing and the opt-out options, we refer to the privacy policies and information of the operators of the respective networks. Also in the case of requests for information and the assertion of data subjects’ rights, we point out that these can be most effectively asserted with the providers. Only the providers each have access to the users’ data and can directly take appropriate measures and provide information. Should you nevertheless need help, you can contact us.

Types of data processed: Contact data (e.g. e-mail, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta/communication data (e.g. device information, IP addresses).
Data subjects: Users (e.g. website visitors, users of online services).
Purposes of processing: Contact inquiries and communication; feedback (e.g. collecting feedback via online form); marketing.
Legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR).

Plugins and Embedded Functions and Content

We integrate functional and content elements into our online offering that are obtained from the servers of their respective providers (hereinafter referred to as “third-party providers”). These may be, for example, graphics, videos or city maps (hereinafter uniformly referred to as “content”). The integration always requires that the third-party providers of this content process the IP address of the users, since without the IP address they could not send the content to their browser. The IP address is therefore necessary for the display of this content or functions. We endeavor to use only content whose respective providers use the IP address solely for the delivery of the content. Third-party providers may also use so-called pixel tags (invisible graphics, also referred to as “web beacons”) for statistical or marketing purposes. The pixel tags can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user’s device and may contain, among other things, technical information about the browser and the operating system, referring websites, time of visit, and other information about the use of our online offering, as well as be linked with such information from other sources.

Types of data processed: Usage data (e.g. websites visited, interest in content, access times); meta/communication data (e.g. device information, IP addresses); inventory data (e.g. names, addresses); contact data (e.g. e-mail, telephone numbers); content data (e.g. entries in online forms); location data (information on the geographic position of a device or person); event data (Facebook) (“event data” is data that may be transmitted by us to Facebook, e.g. via Facebook pixel (via apps or by other means), and relates to persons or their actions; this data includes, e.g., information about visits to websites, interactions with content, functions, installations of apps, purchases of products, etc.; the event data is processed for the purpose of forming target audiences for content and advertising information (custom audiences); event data does not include the actual content (such as comments written), no login information and no contact information (i.e. no names, e-mail addresses and telephone numbers). Event data is deleted by Facebook after a maximum of two years; the target audiences formed from it are deleted with the deletion of our Facebook account).
Data subjects: Users (e.g. website visitors, users of online services).
Purposes of processing: Provision of our online offering and user-friendliness; provision of contractual services and customer service; profiles with user-related information (creation of user profiles); marketing.
Legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR); consent (Art. 6(1) sentence 1 lit. a) GDPR).

Further notes on processing operations, procedures and services:

  • Integration of third-party software, scripts or frameworks (e.g. jQuery): We integrate software into our online offering that we retrieve from the servers of other providers (e.g. function libraries that we use to display or improve the user-friendliness of our online offering). In doing so, the respective providers collect the IP address of the users and can process it for the purposes of transmitting the software to the users’ browser, as well as for purposes of security, and for the evaluation and optimization of their offering; legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR).
  • Facebook plugins and content: Facebook social plugins and content – This may include, for example, content such as images, videos or texts and buttons with which users can share content of this online offering within Facebook. The list and appearance of the Facebook social plugins can be viewed here: https://developers.facebook.com/docs/plugins/ – We are jointly responsible with Meta Platforms Ireland Limited for the collection or receipt in the context of a transfer (but not the further processing) of “event data” that Facebook collects by means of the Facebook social plugins (and content embedding functions) that are executed on our online offering, or receives in the context of a transfer, for the following purposes: a) display of content and advertising information that corresponds to the presumed interests of the users; b) delivery of commercial and transaction-related messages (e.g. addressing users via Facebook Messenger); c) improvement of ad delivery and personalization of functions and content. We have concluded a special agreement with Facebook (“Controller Addendum”, https://www.facebook.com/legal/controller_addendum), which in particular regulates which security measures Facebook must observe (https://www.facebook.com/legal/terms/data_security_terms) and in which Facebook has agreed to fulfill the data subjects’ rights. Note: If Facebook provides us with metrics, analyses and reports (which are aggregated, i.e. do not contain information about individual users and are anonymous to us), then this processing does not take place within the framework of joint controllership, but on the basis of a data processing agreement (“Data Processing Terms”, https://www.facebook.com/legal/terms/dataprocessing), the “Data Security Terms” (https://www.facebook.com/legal/terms/data_security_terms), as well as, with regard to processing in the USA, on the basis of standard contractual clauses (“Facebook EU Data Transfer Addendum”, https://www.facebook.com/legal/EU_data_transfer_addendum); service provider: Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland; legal bases: Consent (Art. 6(1) sentence 1 lit. a) GDPR); website: https://www.facebook.com; privacy policy: https://www.facebook.com/about/privacy.

The provider of the fonts is informed of the user’s IP address so that the fonts can be made available in the user’s browser. In addition, technical data (language settings, screen resolution, operating system, hardware used) is transmitted, which is necessary for the provision of the fonts depending on the devices used and the technical environment. This data may be processed on a server of the font provider in the USA; service provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; legal bases: Legitimate interests (Art. 6(1) sentence 1 lit. f) GDPR); website: https://fonts.google.com/; privacy policy: https://policies.google.com/privacy.

Amendment and Update of the Privacy Policy

We ask you to inform yourself regularly about the content of our privacy policy. We adjust the privacy policy as soon as the changes in the data processing carried out by us make this necessary. We will inform you as soon as the changes require an act of cooperation on your part (e.g. consent) or other individual notification. Insofar as we provide addresses and contact information of companies and organizations in this privacy policy, please note that the addresses may change over time, and we ask you to check the information before making contact.

Rights of Data Subjects

As a data subject, you are entitled to various rights under the GDPR, which arise in particular from Art. 15 to 21 GDPR:

  • Right to object: You have the right, on grounds relating to your particular situation, to object at any time to the processing of personal data concerning you which is carried out on the basis of Art. 6(1) lit. e or f GDPR; this also applies to profiling based on these provisions. If the personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling insofar as it is related to such direct marketing.
  • Right to withdraw consent: You have the right to withdraw consent given at any time.
  • Right of access: You have the right to request confirmation as to whether data concerning you is being processed, and to information about this data as well as further information and a copy of the data in accordance with the legal requirements.
  • Right to rectification: In accordance with the legal requirements, you have the right to request the completion of the data concerning you or the rectification of inaccurate data concerning you.
  • Right to erasure and restriction of processing: In accordance with the legal requirements, you have the right to request that data concerning you be erased without delay, or alternatively, in accordance with the legal requirements, to request a restriction of the processing of the data.
  • Right to data portability: You have the right to receive data concerning you that you have provided to us, in accordance with the legal requirements, in a structured, commonly used and machine-readable format, or to request its transmission to another controller.
  • Complaint to a supervisory authority: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the member state of your habitual residence, place of work, or the place of the alleged infringement, if you consider that the processing of personal data concerning you infringes the requirements of the GDPR.

Definitions of Terms

In this section you will find an overview of the terms used in this privacy policy. Many of the terms are taken from the law and defined above all in Art. 4 GDPR. The legal definitions are binding. The following explanations, on the other hand, are intended above all to aid understanding. The terms are sorted alphabetically.

  • Firewall: A firewall is a security system that protects a computer network or an individual computer from unwanted network access.
  • Conversion measurement: Conversion measurement (also referred to as “visit action evaluation”) is a procedure with which the effectiveness of marketing measures can be determined. For this purpose, a cookie is generally stored on the users’ devices within the websites on which the marketing measures take place, and then retrieved again on the target website. For example, we can thereby understand whether the advertisements we have placed on other websites were successful.
  • Personal data: “Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Profiles with user-related information: The processing of “profiles with user-related information”, or “profiles” for short, includes any kind of automated processing of personal data consisting of the use of such personal data to analyze, evaluate or predict certain personal aspects relating to a natural person (depending on the type of profiling, this may include different information concerning demographics, behavior and interests, such as the interaction with websites and their content, etc.) (e.g. interests in certain content or products, click behavior on a website, or location). Cookies and web beacons are frequently used for profiling purposes.
  • Reach measurement: Reach measurement (also referred to as web analytics) serves to evaluate the visitor flows of an online offering and may include the behavior or interests of visitors in certain information, such as content of websites. With the help of reach analysis, website owners can, for example, recognize at what time visitors visit their website and what content they are interested in. This enables them, for example, to better adapt the content of the website to the needs of their visitors. For the purposes of reach analysis, pseudonymous cookies and web beacons are frequently used to recognize returning visitors and thus obtain more precise analyses of the use of an online offering.
  • Location data: Location data is generated when a mobile device (or another device with the technical prerequisites for location determination) connects to a radio cell, a WLAN or similar technical means and functions of location determination. Location data serves to indicate at which geographically determinable position on earth the respective device is located. Location data can be used, for example, to display map functions or other location-dependent information.
  • Tracking: “Tracking” refers to the ability to trace the behavior of users across several online offerings. As a rule, behavior and interest information regarding the online offerings used is stored in cookies or on servers of the providers of the tracking technologies (so-called profiling). This information can subsequently be used, for example, to display advertisements to users that are likely to correspond to their interests.
  • Controller: “Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
  • Processing: “Processing” is any operation or set of operations which is performed on personal data, whether or not by automated means. The term is broad and encompasses practically any handling of data, be it collection, evaluation, storage, transmission or erasure.
